Terms and Conditions
N & W Livestock are not veterinarians and cannot provide a diagnosis or discuss treatments. All services provided are in accordance with the relevant standards and guidelines and do not include restricted acts of veterinary science.
In case of an emergency, sick or injured animals please contact your local veterinary practise, if you are unable to speak with a vet for whatever reason N & W Livestock can provide you with a list of our preferred providers and will assist with supportive care where possible.
Animal Husbandry Services
On booking our husbandry services, the “Owner” is to comply and acknowledges with the following in respect of the Terms and Conditions as per below.
- The Owner acknowledges that N & W Livestock Pty Ltd will take all reasonable care and precaution in the wellbeing & care of the Livestock but accepts no responsibility or liability for any injury, loss or damage that may be suffered by the Livestock as a result of general animal husbandry services. In particular but without limitation, the Owner expressly acknowledges that:
- It is expected that the Owner will dutifully inform N & W Livestock Pty Ltd of any issues, medical or emotional, that the Livestock has or has had in the past.
- The Owner will ensure that yards and fences are appropriate animal-handling facilities and aids such as cradles and crushes. Yards, crushes, cradles and sheds should be suitable in size and strength for the animals being handled.
- The Owner acknowledges and confirms that at any point the team feel unsafe the services will be terminated and the Owner will be liable for any out-of-pocket expenses and call out fees.
- The Owner acknowledges and confirms that our services do not include mustering of livestock booked for animal husbandry services and that all animals are to be safely contained and ready for the team’s arrival.
Boarding / Off Site Supportive Care
On admission, the “Owner” is to comply with the following in respect of the Terms and Conditions as per below.
- In the event that the Livestock requires veterinary attention and the Owner is not contactable, N & W Livestock Pty Ltd may use its discretion in obtaining such veterinary attention as is deemed necessary and the Owner will be liable for or to reimburse the costs of such attention.
- The Owner acknowledges that N & W Livestock Pty Ltd will take all reasonable care and precaution in the wellbeing care of the Livestock but accepts no responsibility or liability for any injury, loss or damage that may be suffered by the Livestock while in its care. In particular but without limitation, the Owner expressly acknowledges that:
- N & W Livestock Pty Ltd allows livestock under its care to exercise in secure, fenced outdoor paddocks but will not be held responsible for the escape of the Livestock through no wilful or negligent act on its part nor for any injury, loss or damage caused by or to the Livestock as a result of such escape or exercise;
- N &W Livestock Pty Ltd will not be held responsible for snake bites, ticks, paralysis tick, parasite or similar illness or condition contracted by the Livestock.
- N & W Livestock Pty Ltd will not be held responsible for Injury to loss of livestock due to extreme weather conditions or acts of god.
- N & W Livestock Pty Ltd will take all reasonable steps and precautions to ensure the health of Livestock, but assumes no liability for any animal that may be become ill or expire due to exposure to a communicable disease by any other Livestock or animal.
- The Owner declares and confirms that their Livestock has not been declared a dangerous Livestock in any state or territory of Australia.
- The Owner declares and confirms that their Livestock has not been exposed or infected with any communicable diseases that may impact the health of other Livestock.
- N & W Livestock Pty Ltd assumes no responsibility for any Livestock that have not been de-sexed and cannot ensure that they will not become pregnant whilst under the care of N & W Livestock Pty Ltd.
- All gear, halters, ropes and/or coats are left at the Owners risk and N & W Livestock Pty Ltd does not assume any responsibility for the safe return of any such items.
- Wellbeing care charges are calculated on a as needed basis in regards to medication, IV treatment etc. All charges and expenses incurred must be paid by the Owner prior to collection of the Livestock. Pending payment, N&W Livestock may exercise a lien over the Livestock including further charges incurred.
- Any care required above and beyond the standard care of Livestock (Extraordinary Care) must be paid in full by the Owner at such time that it becomes payable. Failure to pay for Extraordinary Care when it is payable, and prior to collection of the Livestock, may result in N & W Livestock Pty Ltd exercising a lien over the Livestock for the cost of the Extraordinary Care and any legal costs incurred.
- In the event that the Livestock is not collected by the due date (or any agreed extension of that date) and care charges and expenses incurred have not been paid within 14 days after that date, N & W Livestock Pty Ltd may sell or otherwise dispose of the Livestock at its discretion with all costs incurred to be for the additional account of the Owner and any moneys received to be applied towards the account.
- N & W Livestock Pty Ltd takes all care with your Livestock but is not responsible for any injuries incurred whilst in the care of N & W Livestock Pty Ltd, including but not limited to any joint injuries, cuts, abrasions, ligament damage, tears etc. It is expected that the Owner will dutifully inform N & W Livestock Pty Ltd of any issues, medical or emotional, that the Livestock has or has had in the past.
